In this article I present the phenomenological tradition as a new grounding for human rights as universal rights. The hypothesis defended is to conciliate Husserl’s phenomenological method and Reinach’s a priori law in order to offer a new grounding to human rights. In order to combine Husserl and Reinach’s ideas, I propose to expand the comprehension of a priori. It would be present as eidos of each object and I name it as material a priori; it also be present in (...) the eidetic relations and I name it as formal a priori. Yet the object would have an essence, a necessary content, a material a priori, and necessary states of affairs, necessary relations and connections, a formal a priori. Reinach, in The A priori Foundations of the Civil Law, describes eidetic relations, such as, the relation between promise, claim and obligation. I propose three eidetic universalities to ground law, these are what I will call human rights. I also face a few difficulties presented by DuBois and De Vecchi derived from the amoral approach of a priori laws. Then, I highlight the difference between this proposition and Albert’s. Finally, I defend the proposition that a priori laws are beyond natural and positive laws. (shrink)

Anne Finch Conway es una de las filósofas del siglo XVII que discutió con los filósofos destacados de su época. La única obra con la que contamos de esta autora es Principia Philosophiae Anticissimae et Recentissimae o The Principle of the Most Ancient and Modern Philosophy. En este artículo me propongo dar cuenta del rol que la naturaleza humana tiene en su metafísica, de modo de encontrar un lugar más específico para el dolor y el sufrimiento en un mundo que (...) parece ante todo gobernado por el amor recíproco y la simpatía. El concepto de hombre microcosmos y la relación de este con Cristo tiene una importancia poco destacada por la bibliografía sobre nuestra filósofa. Con esta meta, presentaré su metafísica prestando especial atención a la sustancia creada y su relación con la sustancia media, Cristo, y la sustancia primera, Dios. De este modo, además, daré cuenta de la responsabilidad que la naturaleza humana tiene con el mundo de la creación, por lo cual me permito mencionar también lo “ecológico” en el pensamiento de Conway, ya que el perfeccionamiento de la naturaleza humana es el perfeccionamiento de toda la naturaleza. This article examines the special features of the atmosphere in Habsburg’s Vienna, which led to the formation of such a direction in philosophical thought as a critique of language (Sprachkritik) and the influence its representatives such as Karl Kraus and Fritz Mauthner on the later Ludwig Wittgenstein’s views on language. I argue that Sprachkritik was inextricably connected with Sprachkrise (crisis of language), Sprachkrise was a strongly Austrian phenomenon due to special socio-cultural-political reasons and which led to the consideration of the (...) very phenomenon of language from a new point of view. Here I claim that Ludwig Wittgenstein, a ‘product’ of Habsburg’s Vienna, was strongly influenced by the intellectual atmosphere of the critique of language reigning in it. In Roberto Poli’s (1997: 16), scholar in sociology and philosophy, words, the “language-world relationship was a central element of the intellectual debate of those years: suffice it to mention Rainer Maria Rilke and Hugo von Hofmannsthal among writers, and Fritz Mauthner and Ludwig Wittgenstein among philosophers.” . In this article I consider Eugen Fink’s critique of Husserlean approach to language in phenomenology, first of all in the ‘middle’ and ‘late’ periods of Husserlean works since Ideas I. Fink was Husserl’s student and assistant and, also, he was influenced by Heidegger’s ideas. In his works he criticized insufficient attention and unworked position to language in Husserl’s works. He believed that language is very important to the whole theory of phenomenology, that we cannot carry out true phenomenological reduction without (...) clarifying what language is, how it is related to our thinking, is it possible to think without language and is it possible to carry out a complete phenomenological reduction. El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. Tennemann y el romántico T. Rixner son representantes del periodo de gestación de la historia de la filosofía como disciplina, y sus obras son fuentes para destacados filósofos, como por ejemplo Hegel. Se muestra hasta qué punto las líneas interpretativas que iniciaron estos autores se continúan hasta (...) la actualidad. The article explores the philosophical filiations of Johannes Scotus Eriugena (9th century) established by three historians of philosophy (from the 18th and 19th centuries). J. Brucker, an Enlightenment thinker, W. Tennemann, a Kantian, and T. Rixner, a Romantic, are representatives of the period in which the history of philosophy becomes a discipline, and their works are sources for famous philosophers such as Hegel. The paper shows the extent to which the interpretive lines initiated by these authors are continued up to the contemporary period. Neste artigo, pretende-se dar conta da afiliação filosófica que três historiadores da filosofia (dos séculos XVIII e XIX) outorgam a Juan Escoto Eriúgena (século IX). O iluminista J. Brucker, o kantiano W. Tennemann e o romántico T. Rixner são representantes do período de gestação da história da filosofia como disciplina, e suas obras são fontes para destacados filósofos, como por exemplo, Hegel. Discussion of modeling within philosophy of science has focused in how models, understood as finished products, represent the world. This approach has some issues accounting for the value of modeling in situations where there are controversies as to which should be the object of representation. In this work I show that a historical analysis of modeling complements the aforementioned representational program, since it allows us to examine processes of integration of analogies that play a role in the generation of criteria (...) of relevance, which are important for the configuration of the object of research. This, in turn, shows that there are norms in modeling practices whose historical reconstruction is relevant for their philosophical analysis. (shrink)

En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. The present paper 1departs from the discussion on the foundation of morality in Discourse Ethics (DE) and the criticism raised against it, coming to reconstruct in a somewhat different way the foundational process. A first section is dedicated to analysing the difficulties of Habermas distinction between morality and ethics and the criticism raised against it, questioning a) the possibility to set the difference in the distinction between norms and values and b) the presumed neutrality of DE regarding ethical evaluations. A (...) second section revisits the foundational proposal of DE. First of all, it provi- des an interpretation of the Kantian proposal that makes the universalization of norms subservient to the idea of human beings as ends in themselves. It then considers a) the subsistence of Kantian moral reasoning in its architectonic and b) suggests a formal structure in practical thinking that integrates in hierarchical modus Kantian, discursive and contextually determined evaluative conceptions. This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the (...) conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

A Crítica de Hume ao Argumento do Desígnio José Oscar de Almeida Marques Dep. de Filosofia – UNICAMP -/- RESUMO: É comum considerar que o chamado “argumento do desígnio” (o argumento a posteriori para provar a existência de Deus a partir da ordem e funcionalidade do mundo) teria sido refutado ou seriamente abalado por Hume. Mas a natureza e o alcance dessa alegada refutação são problemáticos, pois Hume muitas vezes expressou suas críticas através de seus personagens e evitou assumi-las diretamente (...) enquanto autor. Em vez de supor que Hume procedeu dessa forma apenas para disfarçar suas verdadeiras convicções e evitar um conflito com as autoridades eclesiásticas, proponho que sua posição nesse assunto não é tão categórica como às vezes se supõe, e que os famosos argumentos de Filo nos Diálogos mostram apenas que é possível que a ordem e funcionalidade do mundo tenham surgido sem a intervenção de um desígnio consciente, mas não podem por si sós dar a essa hipótese o mínimo grau de plausibilidade necessário para torná-la digna de uma séria consideração. De fato, antes da revolução explicativa operada por Darwin um século depois, ninguém estava realmente em condições de vislumbrar uma alternativa plausível à atuação de algum tipo de inteligência na geração da ordem e funcionalidade do mundo. ------------ Some Remarks on Hume’s Critique of the Argument from Design José Oscar of Almeida Marques Dep. of Philosophy - UNICAMP -/- ABSTRACT: The so-called “argument from design” (the a posteriori argument to prove the existence of God from the order and functionality of the world) is commonly considered to have been refuted or seriously impaired by Hume. But the nature and scope of this alleged refutation is problematic because Hume often expressed his critics through other characters’ mouth and avoided to assume them directly as author. Contrarily to the supposition that Hume proceeded in this way only to disguise his true convictions and to avoid a confrontation with the ecclesiastical authorities, I propose that his stance on the matter is not, in fact, as clear-cut as it is sometimes supposed, and that Philo’s famous arguments in the Dialogues show only that it is possible for the order and functionality of the world to have arisen without the intervention of an intelligent design, but cannot by themselves lend to this hypothesis the least degree of plausibility needed to make it worthy of serious consideration. In fact, before the explanatory revolution inaugurated by Darwin a century later, nobody was in position to envisage a plausible alternative to the operation of some sort or other of intelligence in the generation of the order and functionality of the world. This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. This paper elaborates some of the conceptual implications of Derrida’s call for “another thinking of life” in Voyous: Deux essais sur la raison. The paper first argues that Derrida’s deconstruction of the opposition between metaphorical and literal uses of the discourse of life in La vie la mort is radicalized in Voyous when he argues that democracy’s “autoimmunitary suicide” should be the point of departure for rethinking life in general. To understand further these autoimmune-suicidal tendencies, the paper turns to Derrida’s (...) engagement with Aristotle’s conceptual figure of the prime mover in Voyous. The paper argues that Derrida turns to Aristotle because the prime mover illustrates the ways in which the concept of life remains historically and structurally informed by the philosophical value of ipseitocratic sovereignty, which is allergic to the disseminatory, proliferating, and improper qualities that the philosophical tradition has always ascribed to democracy. Autoimmunity thus provides a way for thinking of a democratic life that is not entirely determined by the teleological power of any divinely good life. (shrink)

Resumen: Husserl propone una teoría sobre la intersubjetividad que parte de la conciencia trascendental como inserta en el mundo de la vida donde están los otros y donde la comunidad se construye bajo una estructura de esencias que garantiza la comunalidad. El mundo de la vida es dado y compartido por todas las conciencias intencionales y trascendentales, es condición para intuiciones empíricas y eidéticas, la epoché y las reducciones eidética y trascendental. Cada momento del método fenomenológico se basa en la (...) existencia de un mundo de la vida independiente de la subjetividad. En este mundo, hay objetos reales y, entre estos, los otros, reconocidos por analogía a través de la empatía. Desde una perspectiva metodológico-epistemológico, el yo es anterior al mundo y a los otros yos. El yo constituye, en sentido fenomenológico, la realidad. La conciencia es el lugar de evidenciación de la realidad. No obstante, en la perspectiva ontológica, es lo contrario. El mundo de la vida es anterior a la conciencia individual. El mundo de la vida está ahí, disponible, existente, independiente del sujeto, funcionando con su propio orden, con sus leyes y reglas. Es el yo el que esta insertado en el mundo de la vida y que se esfuerza por desvendarlo. La realidad se impone y el yo es, sobre todo, miembro de una comunidad de otros yos. Aun así, ¿cómo compartir las experiencias? Las vivencias pueden ser diferentes, pero hay un límite en las variaciones, un límite dado por la esencia del objeto vivido y por las leyes que rigen las relaciones de tal objeto. Así, la constitución del mundo y de sus objetos está permanentemente en progreso. Es posible donarles nuevos sentidos, en los límites de su esencia. Para Husserl, la constitución comunal del mundo es la condición de posibilidad para la existencia de sujetos separados unos de los otros, y este entendimiento recíproco solo es posible a través de la constitución trascendental de la objetividad. Así, no hay una separación entre la intersubjetividad y la constitución del mundo, es la comunidad de yos la que dona sentidos a las objetividades. En el mundo de la vida con los otros en comunidad. -/- Abstract: Husserl proposes a theory on intersubjectivity that starts from transcendental consciousness as inserted in the lifeworld where the others and where the community are built under a structure of essences that guarantees communality. The lifeworld is given and shared by all intentional and transcendental consciousnesses, it is a condition for empirical and eidetic intuitions, the epoché and the eidetic and transcendental reductions. Every moment of the phenomenological method is based on the existence of a lifeworld independent of subjectivity. In this world, there are real objects and, among these, the others, recognized by analogy through empathy. From a methodologicalepistemological perspective, the self is prior to the world and the other selves. The self constitutes, in a phenomenological sense, reality. Consciousness is the locus of evidence of reality. However, from the ontological perspective, it is the opposite. The lifeworld is prior to individual consciousness. The lifeworld is there, available, existing, independent of subjectivity, functioning with its own order, with its laws and rules. It is the self that is inserted in the lifeworld and that strives to unveil it. Reality prevails and the self is, above all, a member of a community of other selves. Even so, how to share the experiences? The experiences can be different, but there is a limit in variations, a limit given by the essence of the lived object and by the laws that govern the relation of the object. Thus, the constitution of the world and its objects is permanently in progress. It is possible to give them new meanings, within the limits of their essence. For Husserl, the communal constitution of the world is the condition of possibility for the existence of subjects separated from each other, and this reciprocal understanding is only possible through the transcendental constitution of objectivity. therefore, there is no separation between intersubjectivity and the constitution of the world, it is the community of selves that gives meaning to objectivities. Resumen Este trabajo consiste en un análisis histórico de textos que proceden de un expediente archivístico de Cartagena de Indias entre 1715 y 1717. Los autos son textos administrativos que poseen diversas funciones en las relaciones institucionales entre metrópoli y colonias, tal como la de “emitir opinión”. En la tipología textual indiana, esta función se denomina consulta o parecer, y se caracteriza por el uso de un predicado de tipo doxástico. Para el análisis hemos adoptado las perspectivas teóricas del análisis (...) histórico del discurso y de la sociopragmática histórica. El estudio se completa con un análisis cuantitativo que permite resaltar cuáles son los rasgos lingüísticos a los que se vincula la intensificación y la atenuación en el subtipo debate dentro del registro legal en el español de la Cartagena del siglo XVIII. La conclusión sugiere que los recursos lingüísticos encontrados aumenta la intención persuasiva de la argumentación característica de los autos cartagineses. (shrink)

The idea of the life-world: Life-world is a concept present in various texts about Husserl’s phenomenology. Some interpreters consider it a late and inconsistent concept present in The Crisis of European Sciences and Transcendental Phenomenology. In this paper, I argue that the idea of the life-world had already been thought in Husserl’s early texts such as Ideas II. This idea was firstly named as surrounding world, then world of experience, and finally life-world. However, despite the different nomenclature, the essence of (...) the life-world remains the same throughout his work. The life-world is a priori, transcendent, and co-given. I will analyze each of these characteristics and conclude in favor of a conceptual monism running through Husserl’s work. Keywords: Husserl, life-world, a priori, transcendent, co-given. (shrink)

A questão dos universais permanece tema na filosofia tanto na ontologia como na epistemologia. Em Husserl, há universais particulares, o ‘X’ noemático, o idêntico, e universais stricto sensu, nomes universais atemporais. Neste artigo, apresento o tema conforme analisado por Husserl em Ideias I. Na primeira seção, descrevo a trajetória até os universais destacando o paralelismo entre noese e noema. Na segunda seção, traço o reflexo para a filosofia da linguagem também afetada pela correspondência noético-noemática. Na terceira e última seção, mostro (...) como a investigação sobre os universais move-se apenas na esfera noemática, e concluo defendendo a possibilidade de partindo do ‘X’ noemático alcançar o universal em sentido estrito. En el presente trabajo se parte de que la innovación requiere transmisión de información. En la actualidad, el contenido de la transmisión de información se halla sometido a una regulación legal, habitualmente la propiedad intelectual, donde los agentes intervinientes y su requisito de sistema de permisos dificultan la transmisión libre. Para solucionar esta problemática, se están promoviendo dos tipos de soluciones: el primero mediante código legal y el segundo mediante código informático. Estas soluciones, que se fundamentan en razones morales, tienen (...) consecuencias políticas y determinan el modelo de sociedad que podemos construir mediante el conocimiento transmitido. (shrink)

The problem of universals remains a philosophical theme not only in ontology but also in epistemology. In Husserl, there are particular universals, the noematic ‘X’, the identical, and universals stricto sensu, atemporal universal names. In this paper, I present the theme as it is analyzed by Husserl in Ideas I. In the first section, I describe the trajectory to the universals highlighting the parallelism between noese and noema. In the second section, I draw the reflection of this problem on the (...) philosophy of language which is also affected by the noeticnoematic correspondence. In the third and last section, I show how the investigation about the universals moves in the noematic sphere, and conclude defending the possibility of reaching the universal strict sense departing from the noematic ‘X’. This paper deals with Veronica Rodriguez-Blanco’s answer to the paradox of the normativity of law: How can autonomous self-legislating persons act, without compromising their autonomy and their will, following legal rules? Regarding Rodriguez-Blanco’s answer, I offer two main critiques. The first one is based on Rodriguez-Blanco’s comments to David Enoch’s paper in which I argue against the idea that a descriptive theoretical account of law can, and should, give an answer to general problems of normativity due to the fact that (...) a theoretical approach that engages in questions about the normativity of law cannot be purely descriptive, therefore against Rodriguez-Blanco I conclude that Enoch’s answer is the only response a descriptive account is able to offer. The second criticism focuses on Rodriguez-Blanco’s response to the paradox and argues that her solution is not, in fact, a descriptive one, but one that relies on strong normative premises, which as it turns out defend a perfectionist perspective towards the law.Resumen:Este trabajo analiza la respuesta que Veronica Rodriguez-Blanco propone para resolver la paradoja de la normatividad del derecho: ¿Cómo es posible que una persona autónoma actúe siguiendo los mandatos de normas jurídicas sin comprometer su autonomía ni su voluntad? El autor ofrece dos críticas a la respuesta de Rodriguez-Blanco. La primera de ellas está basada en los comentarios que Rodriguez-Blanco ha hecho sobre la propuesta de David Enoch. En este punto, el autor argumenta en contra de la idea según la cual una perspectiva descriptiva del derecho puede, y debe, tratar de responder a los problemas generales de la normatividad del derecho. De acuerdo con el autor, una perspectiva que pretenda dar respuesta a los problemas de la normatividad del derecho no puede ser una perspectiva puramente descriptiva. En este sentido, el autor sostiene que la respuesta que ofrece Enoch es la única respuesta que una perspectiva descriptiva del derecho puede dar. La segunda crítica está dirigida a la respuesta que Rodriguez-Blanco da sobre la paradoja de la normatividad. En este segundo punto el autor argumenta que la perspectiva de Rodriguez-Blanco no es una perspectiva descriptiva como ella presume, sino que adopta una perspectiva normativa la cual, además, está comprometida con una idea perfeccionista del derecho. A reflection on the philosophical traditions at the Autonomous University of Nuevo Leon and in the city of Monterrey.

El contenido de la obra se halla dividido en dos partes, una primera teórica y otra segunda práctica. En la primera parte se realiza una explicación analítica del ciberactivismo mientras que la segunda se centra en reflexiones sobre aspectos concretos que pudieran ser útiles para quien desee planificar alguna acción.

Resumo: neste artigo pretendo estender a evidenciação do encobrimento do mundo da vida formulada por Husserl ao uso das tecnologias disruptivas da 4ª Revolução Industrial, mais precisamente o uso da inteligência artificial (IA) nas plataformas sociais. Primeiro, apresento o conceito de mundo da vida que se mantém consistente ao longo das obras de Husserl; em seguida, apresento seu encobrimento derivado da matematização da natureza e do rompimento com o telos, o que originou a crise da humanidade europeia. Segundo, mais camadas (...) de encobrimento do mundo da vida vão se sobrepondo com a 3ª e 4ª RIs. Em mais detalhe, o encobrimento e o afastamento do mundo da vida provocado pelo uso da IA e seus efeitos negativos, individual e coletivamente. Terceiro, a proposta Husserliana de retorno ao mundo da vida através de uma epoché radical. Concluo que a solução proposta por Husserl para a crise ainda é atual e urgente. Abstract: in this paper I intend to extend the disclosure of the cover-up of the lifeworld formulated by Husserl to the use of disruptive technologies of the 4th Industrial Revolution, more precisely the use of artificial intelligence on social platforms. First, I present the concept of lifeworld that remains consistent throughout Husserl's works; then, I present its cover-up derived from the mathematization of nature and the break with the telos, which originated the crisis of european humanity. Second, more layers of cover-up of the lifeworld overlap with the 3rd and 4th IRs. In more detail, the cover-up and detachment from the lifeworld caused by the use of AI and its negative effects, individually and collectively. Third, the Husserlian proposal of return to the lifeworld through a radical epoché. I conclude that the solution proposed by Husserl to the crisis is still actual and urgent. (shrink)

Resumo: A Logoterapia proposta por Viktor Frankl está fundamentada na teoria dos valores e antropologia de Max Scheler. Frankl constrói seu pensamento psicológico baseado em conceitos-chave do pensamento scheleriano como (i) o valor e os bens, (ii) o querer e os sentimentos, (iii) a hierarquia de valores e (iv) a ideia de pessoa. É com eles que desenvolve suas teses originais da (i) motivação espiritual da ação humana, (ii) busca de sentido e (iii) inconsciente espiritual. Ao fazê-lo, ofereceu não só (...) uma psicoterapia dos valores, mas também uma nova teoria da motivação humana positiva, não concebida como fruto de deficiência ou necessidade, mas do espírito livre direcionado a valores objetivos. Abstract: In this article I intend to highlight how the relationship between the psychic ego (seelischen Ich) and the spiritual ego (geistige Ich) is fundamental to the understanding of intersubjectivity and the lifeworld (Lebenswelt). In Ideas II, Husserl explains how, from the ego, natural, psychic and spiritual objectivities are constituted. These three strata of objectivity are known, first, in the theoretical attitude and, second, in the spiritual attitude. In this process, the ego becomes explicit. In the theoretical attitude, the constitution (...) of nature takes place, for which the body (Körper/Leib) is fundamental. This is followed by the constitution of objects of psychic nature, human or animal (tierisch), including self-perception. In assuming the spiritual attitude, the other is perceived (Urpräsenz) initially as a body together with things, and alongside this perception there is an apprehension (Appräsenz) of co-given horizons. There is an identity between the body of others and mine; it is the moment of empathy (Einfühlung). The scientific world constituted in the theoretical attitude is a reduction of the surrounding world (Umwelt) – the lifeworld (Lebenswelt). This lifeworld is the world of spiritual attitude and precedes any comprehension or explanation of the world. Viktor Frankl’s Logotherapy is based on Max Scheler’s theory of values and anthropology. Frankl builds his psychological thinking based on critical concepts of Schelerian thinking such as (i) value and goods, (ii) will and feelings, (iii) the hierarchy of values, and (iv) the idea of person. It is with them that he develops his original theses of (i) the spiritual motivation of human action, (ii) the search for meaning and (iii) the spiritual unconscious. In doing so, he offered not only (...) a psychotherapy of values, but also a new theory of positive human motivation, not conceived as a result of deficiency or need, but as a result of the free spirit toward objective values. In this paper, I present the difficulty in the phenomenology of explaining the constitution of objectivities in consciousness. In the context of phenomenological reduction, constitution has to be understood as unveiling the universal and necessary essences. Recognized by Husserl in Ideas I and named as functional problems, the constitution of objectivities refers at first to individual consciousness, and then to an intersubjective one. In Ideas II, the phenomenologist explains how the constitution of nature, psyche, and spirit occurs. This process begins (...) by assuming three premises: the ontological realism, the regularity of nature, and the transcendental idealism. In this process, the ego, apart from constituting objects (the body, the psyche, and the others), constitutes itself. The objects of material reality are constituted through aesthetic synthesis which unifies singularities and contextualizes the lived experience. The body, as a perceptive organ, perceives the exterior, and the location of the sensory stimulus is the soul. The soul is a real and transcendent object, which is linked to physical things that are constituted in a solipsistic way or intersubjectively. Empathy allows the subject to recognize the consciousness of the alter ego as capable of spontaneous movements and actions, a co-presence sharing the same horizons. Thus, through the theoretical attitude, the physical world is perceived, and through the spiritual attitude the spiritual world is perceived, a living world shared by free intelligent beings. For this, intersubjectivity fulfills a fundamental role, because only in the relationship with the other does the identity of the objects, of the other, and of the self become evident. (shrink)

In this paper, I discuss the possibility of reading the description of promise presented by Reinach in The Apriori Foundations of the Civil Law under the light of Husserl’s Ideas I. In order to present my argument, first, I briefly present the phenomenological method proposed by Husserl in Ideas I highlighting eidetic reduction. Second, I present the Reinachian description of social acts emphasizing the act of promising. Third, and finally, I try to demonstrate that the Reinachian description of the social (...) act of promising is the description of a universal and necessary relation, a synthetic and a priori statement and corresponds to the idea of promise. No presente capítulo, esta compreensão é apresentada de maneira resumida e, em seguida, apreciada à luz do debate contemporâneo entre o compatibilismo e o incompatibilismo. Ao fim, se pretende justificar a hipótese de que a posição scheleriana neste debate seria em favor do incompatibilismo libertarianista.

In identifying intrinsic molecular chance and extrinsic adaptive pressures as the only causally relevant factors in the process of evolution, the theoretical perspective of the Modern Synthesis had a major impact on the perceived tenability of an ontology of dispositional properties. However, since the late 1970s, an increasing number of evolutionary biologists have challenged the descriptive and explanatory adequacy of this “chance alone, extrinsic only” understanding of evolutionary change. Because morphological studies of homology, convergence, and teratology have revealed a space (...) of possible forms and phylogenetic trajectories that is considerably more restricted than expected, evo-devo has focused on the causal contribution of intrinsic developmental processes to the course of evolution. Evo-devo’s investigation into the developmental structure of the modality of morphology – including both the possibility and impossibility of organismal form – has led to the utilisation of a number of dispositional concepts that emphasise the tendency of the evolutionary process to change along certain routes. In this sense, and in contrast to the perspective of the Modern Synthesis, evo-devo can be described as a “science of dispositions.” This chapter discusses the recent philosophical literature on dispositional properties in evo-devo, exploring debates about both the metaphysical and epistemological aspects of the central dispositional concepts utilised in contemporary evo-devo and addressing the epistemological question of how dispositional properties challenge existing explanatory models in evolutionary biology. We provide here irrefutable facts that prove the falsehood of the claims published in [1] by Dehmer and Mowshowitz (DM) against our paper published in [2]. We first prove that Dehmer’s definition of node probability [3] is flawed. In addition, we show that it was not Dehmer in [3] who proposed this definition for the first time. We continue by proving how the use of Dehmer’s definition does not reveal all the physico-mathematical richness of the walk entropy of graphs. Finally, (...) we show a few facts about the failure of DM themselves to cite properly the relevant literature in their field. We also show here how the Editors of Complexity have failed to manage the publication of [1] in an appropriate way according to the accepted guidelines given in the Code of Conduct and Best Practice Guidelines for Journal Editors, published by the Committee on Publication Ethics (COPE). This article aims to carry out a review and analysis of the relationship and influence of sophist thought and epistemology in modern Brief strategic psychotherapy, Nardone model. The particular interest of this research revolves around the epistemological aspects and the questioning of objective reality and how this may have influenced the praxis of brief therapy. The epistemological, theoretical, and philosophical contributions of the sophists promoted a cultural change in the Hellenic world their legacy continues to this day, greatly influencing various (...) fields of knowledge, from philosophy to psychotherapy. A review of the preliminary evidence published in the philosophical and psychological literature is presented, examining sophist epistemology and its influence on brief strategic therapy, analyzing its epistemological approach related to relativism and skepticism, at the same time showing a philosophy that continues to this day that influences contemporary thinking and modern psychotherapy, especially Brief Strategic Therapy. From the review and analysis, is evidenced the influence of the sophists thinking on epistemology, the questioning of objective reality, and the clinical practice of brief strategic therapy. L’appropriation de la thématique du multiculturalisme par les partisans du républicanisme fait l’objet de cet article. Dans un premier temps, il est permis de se demander si l’idée même d’un multiculturalisme républicain fait sens ; mais comme je le montrerai, le refus d’un projet multiculturel républicain est une exception française. Or, chez les penseurs néo-républicains, tels Philip Pettit, John Maynor et Cécile Laborde, le multiculturalisme a reçu une attention particulière. Je montrerai les particularités de chacune de ces approches et en (...) particulier, comment les travaux de Laborde arrivent à résoudre des tensions que la pensée néo-républicaine entretient avec la reconnaissance de la diversité culturelle, en ajoutant une perspective critique à la voie délibérative ouverte par Maynor. L’originalité du multiculturalisme républicain consiste ainsi à rappeler le caractère instrumental de la politisation des identités minoritaires, puisqu’il s’agit à chaque fois de lutter contre l’assignation identitaire que subissent les membres des minorités, et non pas de valoriser publiquement leurs différences. Panel de discusión del Cuerpo Académico de Estética y Arte realizado en los marcos del Tercer Coloquio Nacional de la Asociación Mexicana de Estudios en Estética, en el que fueron expositores los doctores José Ramón Fabelo Corzo, Gerardo de la Fuente Lora e Isabel Fraile Martín. El doctor Fabelo realizó una presentación general sobre los antecedentes del tema, su significación y perspectivas de desarrollo, en particular sobre las posibilidades de introducción de nuevas categorías, entre ellas la de la “colonialidad del (...) valer”. El doctor De la Fuente, por su parte, centró su intervención en las contradicciones que debe resolver la teoría de la colonialidad para no terminar realizando ella misma una apología a la colonialidad, refiriéndose al papel que en ello puede y debe desempeñar la estética. La doctora Fraile llama la atención sobre lo que podría considerarse el lado positivo de las relaciones de colonialidad que permitieron, entre otras consecuencias, un mutuo enriquecimiento cultural, algo que muestra mediante el análisis del traspaso de imaginarios visuales para los artistas de América Latina. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

Transdisciplinary research knits together knowledge from diverse epistemic communities in addressing social-environmental challenges, such as biodiversity loss, climate crises, food insecurity, and public health. This paper reflects on the roles of philosophy of science in transdisciplinary research while focusing on Indigenous and other subaltern forms of knowledge. We offer a critical assessment of demarcationist approaches in philosophy of science and outline a constructive alternative of transdisciplinary philosophy of science. While a demarcationist focus obscures the complex relations between epistemic communities, transdisciplinary (...) philosophy of science provides resources for meeting epistemic and political challenges of collaborative knowledge production. According to theoretical work on epistemic injustice, baseless discrediting of the knowledge of people with marginalized social identities is a central driver of prejudice and discrimination. Discrediting of knowledge may sometimes be subtle, but it is pernicious, inducing chronic stress and coping strategies such as emotional avoidance. In this research, we sought to deepen the understanding of epistemic injustice’s impact by examining emotional responses to being discredited and assessing if marginalized social group membership predicts these responses. We conducted a novel (...) series of three experiments (Total N = 1690) in which participants (1) shared their factual knowledge about how a game worked or their personal feelings about the game; (2) received discrediting feedback (invalidating remarks), validating feedback (affirming remarks), or insulting feedback (general negative social evaluation); and then (3) reported their affect. In all three studies, on average, affective responses to discrediting feedback were less negative than to insulting feedback, and more negative than to validating feedback. Participants who shared their knowledge reported more negative affect after discrediting feedback than participants who shared their feelings. There were consistent individual differences, including a twice-replicated finding of reduced negative affect after receiving discrediting and insulting feedback for Black men compared to White men and women and Black women. Black men’s race-based traumatic symptom scores predicted their affective responses to discrediting and insulting feedback, suggesting that experience with discrimination contributed to the emotional processing of a key aspect of epistemic injustice: remarks conveying baseless discrediting of knowledge. We aim to develop a take on the meaning of works of art that builds on Dennett’s view on the nature of intentionality, namely, that the intentionality exhibited by mental phenomena is not original, but derived. Regarding the meaning of works of art, theories that hold that the meaning is determined by the intentions of the author when creating the work are considered intentionalist. Adopting the view of derived intentionality implies that it is no longer possible to maintain that the (...) semantic content of a work of art is closely linked to the creative act that gave rise to it; accordingly, intentionalist theories should be, broadly speaking, abandoned. However, we claim that one aspect of intentionalist theories is accurate and, moreover, compatible with the perspective on intentionality we adopt: The fact that part of the meaning of a work of art is given by the interpretations that arise when it is assumed that the work was produced by an agent with the purpose of transmitting something. We call this interpretative strategy the work-of-art stance and argue that it should be understood as a subtype of the intentional stance. According to our proposal, this interpretive strategy is part of a view that tries to explain the meaning of works of art as partially indeterminate, relative to a history (and not to a foundational origin) and dependent on interpretive attribution. En este artículo elaboramos una propuesta sobre el significado de las obras de arte que se apoya en la perspectiva de Dennett acerca de la naturaleza de la intencionalidad de los fenómenos mentales. De acuerdo a ella, la intencionalidad que estos exhiben no es original, sino derivada. Adoptar la perspectiva de la intencionalidad derivada implica que ya no será posible sostener que el significado de una obra de arte esté vinculado al acto creativo que le dio origen o que esté determinado por las intenciones que tuvo su autor al crearlas, como han sostenido las teorías intencionalistas. Ahora bien, creemos que hay un aspecto de estas que no es incompatible con la perspectiva de intencionalidad derivada. Se trata del hecho de que parte del significado de la obra de arte está dado por las interpretaciones que surgen sólo cuando se asume que la misma fue producida por un agente con el propósito de transmitir algo. Llamaremos a esta estrategia interpretativa actitud de la obra de arte y defenderemos que debe ser entendida como un subtipo de la actitud intencional. Esta estrategia interpretativa forma parte de una propuesta que intenta explicar el significado de las obras de arte como siendo parcialmente indeterminado, relativo a una historia y dependiente de la atribución interpretativa.
